The domain name HRVIEW is owned and operated by Hiredpro Training And Placement Private Limited, incorporated under the provisions of the Companies Act, 2013, and having its registered office at No 33 K/N3/2 Mookambhika Nagar 1st C Main Road1 Bsk 3rd Stage Bangalore 560085, Karnataka, where such expression shall, unless repugnant to the context thereof, be deemed to include its respective representatives, administrators, employees, directors, officers, agents, and their successors and assigns.

c) For the purpose of these Terms of Use (“Terms”), wherever the context so requires :

  1. The term ‘You’ & ‘User’ shall mean any legal person or entity accessing or using the Services provided on this Website, who is competent to enter into binding contracts, as per the provisions of the Indian Contract Act, 1872;
  2. The terms ‘We,’ ‘Us,’ & ‘Our’ shall mean the Website and/or the Company, as the context so requires.
  3. The term ‘Products’ shall mean and refer to those items listed for sale on the Website.
  4. The term ‘Seller’ shall mean and refer to any User who wishes to list his/her Product for sale on the Website.

e) The Company reserves the sole and exclusive right to amend or modify these Terms without any prior permission or intimation to the User, and the User expressly agrees that any such amendments or modifications shall come into effect immediately. The User has a duty to periodically check the terms and stay updated on its requirements. If the User continues to use the Website following such a change, the User will be deemed to have consented to any and all amendments/modifications made to the Terms. Insofar as the User complies with these Terms, he/she is granted a personal, non-exclusive, non-transferable, revocable, limited privilege to enter and use the Website.

ACCOUNT REGISTRATION

In order to access some of the features of the HRVIEW, you may be required to create an account with HRVIEW. By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this website. You agree and confirm that you will never use another User’s account nor provide access to your account to any third-party. When creating your account, you confirm that the information provided is accurate and complete.

Furthermore, you agree that you are solely responsible for the activities that occur on your account, and you shall keep your account password secure and not share the same with anyone. You must notify HRVIEW immediately of any breach of security or unauthorized use of your account. At no point in time will HRVIEW be liable for any losses caused by any unauthorized use of your account; you shall solely be liable for the losses caused to HRVIEW or others due to such unauthorized use, if any.

HRVIEW takes no responsibility for any User Content that is uploaded on the HRVIEW Platform, and further, the User shall be solely responsible for their actions in utilizing such User Content and availing the services provided herein.

TESTS & OFFERED PAYMENT

Information about tests offered and prices will be provided on the Website. By using our services, you agree to pay the price for the test you have registered for, as per the pricing schedule indicated on the Site. When making a payment, you are required to provide accurate information regarding your account, including a valid credit card, debit card, or net banking credentials. You must certify that you are over 18 years of age and legally able to enter into a valid and binding agreement with HRVIEW.

PAYMENT TERMS

LIMITED LICENSE

a) The services on the Platform are licensed, not sold. In consideration for your agreement to these Terms, HRVIEW grants you a personal, non-exclusive, non-transferable, revocable license to access and use the Platform and Programs, solely in accordance with these Terms. You may download or copy portions of the HRVIEW Content available on the Platform for your own non-commercial and personal use only, provided you maintain all copyright and other notices contained in such HRVIEW Content.

b) You may not copy, sell, resell, reproduce, publish, modify, transfer, retransmit, distribute, commercially exploit, or create derivative works of Platforms, Programs, or any HRVIEW Content. Notwithstanding the foregoing, certain reference documents, digital textbooks, and articles may be made available to you with the permission of third parties, and use of that information is subject to certain rules and conditions, and you agree to abide by all such rules and conditions.

c) You may not reverse-engineer, decompile, disassemble, or otherwise access the source code for any software that may be used to operate the Platform or the Programs. From time to time, HRVIEW may include software, code, instructions, or other such information in the HRVIEW Content for the Programs; any such information is provided on an "as-is" basis for instructional purposes only and is subject to the ‘Disclaimer’ and ‘Limitation of Liability’ sections below and other terms herein. Any use of such information for commercial purposes is strictly prohibited. HRVIEW and/or its affiliates and licensors reserve all rights not expressly granted herein to the Platforms, HRVIEW Content, and HRVIEW Marks.

TERM

a) These Terms shall continue to form a valid and binding contract between the Parties, and shall continue to be in full force and effect until the User continues to access and use the Website.

b) These Terms shall continue to form a valid and binding contract between the Parties until the Transaction between the Parties, if any, concludes to the satisfaction of both Parties.

TERMINATION

The Company reserves the right, in its sole discretion, to unilaterally terminate the User’s access to the Products and Services offered on the Website, or any portion thereof, at any time, without notice or cause. The User shall continue to be bound by these Terms, and it is expressly agreed to by the Parties that the User shall not have the right to terminate these Terms until the expiry of the same, as described in Section 4 herein above.

CONTENT

The content of the Website, including without limitation, text, copy, audio, video, photographs, illustrations, graphics, and other visuals, is for informational purposes only. Reliance on any information appearing on the Website, whether provided by Company, independent professionals/experts, visitors to the Website, or others, is solely at the user’s own risk.

The user may be able to link from the Website to third party sites, and third party sites may link to the site (“linked sites”). The user acknowledges and agrees that we have no responsibility for the information, content, products, services, advertising, code, or other materials which may or may not be provided by or through linked sites. Links to linked sites do not constitute an endorsement or sponsorship by us of such sites or the information, content, products, services, advertising, code, or other materials presented on or through such sites. The inclusion of any link to such sites on our Website does not imply Company’s endorsement, sponsorship, or recommendation of that site.

SERVICES

All services/tests and information displayed on the Website constitute an "invitation to offer." Request for booking of any tests by a user shall constitute an "offer," which shall be subject to the terms and conditions as detailed in this Agreement and the relevant tests. The Company may accept or reject the user’s offer in its sole discretion, which cannot be contested by the user.

User can purchase a test as detailed under the Website or email us at admissions@hrview.com or call us at 91132 08662. Once the request is placed, it is an express intention to purchase Company’s services as per the tests, and the same may not be canceled except as provided hereunder.

Based on the information provided by the user and subject to the Company’s verification of the same, the requests will be accepted by the Company for processing, and the same will be confirmed via e-mail.

All requests will be processed once the Company receives the payment for the service as detailed under the tests. The prices for services are described on the Website and are incorporated into these terms by reference. All prices are in Indian rupees and are exclusive of applicable tax. The prices, products, and services are subject to change at the Company’s discretion.

In the event of any inadvertent mistake by the Company in quoting the price of a test, the Company will notify the user of the error before the payment is processed. The User will then have the choice to either accept the correct price or to cancel its request.

The Company accepts online payment via Credit Card, Debit Card, and Net Banking. The user is solely responsible for all charges owed for all goods and services booked and/or purchased through the Website. The tests and services of the Company can be purchased by a user by a one-time lump sum payment or through easy monthly installments as provided on the Website.

The user agrees, understands, confirms, and states that the card details provided by the user to transact on the Website will be correct, accurate, and owned by the user. In the event the user uses a card belonging to any third party, then the user confirms that they have been authorized to or expressly permitted by such third party to use the card for making payments. The liability for the use of a card fraudulently will solely be on the user, and the onus to 'prove otherwise' shall be exclusively on the user.

The user shall be solely responsible for compliance with all applicable laws for making payments to the Company. In addition to all other remedies available under law and equity and as detailed under this Agreement, the Company reserves the right to recover any and all costs, expenses, charges, damages of any nature whatsoever from any user using the Website fraudulently. Furthermore, the Company reserves the right to initiate legal proceedings against such persons for fraudulent use of the Website and any other unlawful acts or acts or omissions in breach of these Terms & Conditions.

COMMUNICATION

By using this Website, it is deemed that you have consented to receiving calls, autodialed and/or pre-recorded message calls, e-mails, and SMSs from us at any time with the use of the contact information that has been provided by you for the use of this website, which is subject to the Privacy Policy. This includes contacting you through information received through other parties. This consent to be contacted is for purposes that include and are not limited to clarification, marketing, and promotional calls, e-mails, and messages. In case you wish to stop being contacted by us for the same, you may send us an e-mail to the effect at hrview.com.

You may also be contacted by Service Providers with whom we have entered into a contract in furtherance of our rights, duties, and obligations under this document and all other policies followed by us. Such contact will be made only in pursuance of such objectives, and no other calls will be made.

The sharing of the information provided by you will be governed by the Privacy Policy, and We will not give out your contact information to third parties not connected with the Website.

INTELLECTUAL PROPERTY RIGHTS

The trademarks, logos, and service marks or any other right associated with intellectual property displayed on the Website shall be the property of HRVIEW and/or its affiliates, as the case may be, or respective third parties. The user is not permitted to use the same.

Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, HRVIEW has the license into the trademark “HRVIEW,” and HRVIEW and/or its affiliates, as the case may be, owns all intellectual property rights to and the Website, including, without limitation, any and all rights, title and interest in and to trade names, service marks, logos, domain name, copyright, related rights, patents, utility models, designs, know-how, trade secrets, designs, graphics, and inventions, goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. The user acknowledges and agrees that they shall not use, reproduce, or distribute any content from the Website belonging to HRVIEW and/or its affiliates.

The users agree and acknowledge that any infringement of the intellectual property rights of HRVIEW and/or its affiliates will result in legal action against the user.

HRVIEW respects the intellectual property of others, and we ask our users to do the same. HRVIEW has no responsibility for content on other Websites linked to the Website that you may find or access. It is HRVIEW's policy, in appropriate circumstances and at its discretion, to disable and/or terminate the accounts of users who may infringe or repeatedly infringe the copyrights or other intellectual property rights of HRVIEW and/or others.

You are prohibited from violating or attempting to violate the security of the HRVIEW Platform, including, without limitation, (a) accessing data not intended for such user or logging onto a server or an account that the user is not authorized to access; (b) attempting to probe, scan, or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with service to any user, host, or network, including, without limitation, via means of submitting a virus to the Platform, overloading, "flooding," "spamming," "mailbombing," or "crashing;" (d) sending unsolicited emails, including promotions and/or advertising of products or services; or (e) forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting. Violations of system or network security may result in civil or criminal liability. HRVIEW will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations. You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of this Platform or any activity being conducted on the Platform. You agree, further, not to use or attempt to use any engine, software, tool, agent, or other device or mechanism (including, without limitation, browsers, spiders, robots, avatars, or intelligent agents) to navigate or search the Platform other than the search engine and search agents available from HRVIEW on the Platform and other than generally available third-party web browsers (e.g., Google Chrome or Microsoft Explorer).

USER OBLIGATIONS

Usage of HRVIEW

The User agrees and acknowledges that he/she is a restricted user of HRVIEW, and that he/she :

a) is bound not to cut, copy, distribute, modify, recreate, reverse engineer, distribute, disseminate, post, publish, or create derivative works from, transfer, or sell any information or software obtained from HRVIEW. Any such use/limited use of HRVIEW will only be allowed with the prior express written permission of HRVIEW.

b) agrees not to access (or attempt to access) HRVIEW and/or the materials or Services by any means other than through the interface provided by HRVIEW. The use of deep-link, robot, spider or other automatic device, program, algorithm, or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of HRVIEW or its content, or in any way reproduce or circumvent the navigational structure or presentation of HRVIEW, materials, or any content, or to obtain or attempt to obtain any materials, documents, or information through any means not specifically made available through HRVIEW will lead to suspension or termination of the User’s access to HRVIEW, as detailed in Section 12 herein below.

c) The User acknowledges and agrees that by accessing or using HRVIEW or any of the Services provided therein, he/she may be exposed to content that he/she may consider offensive, indecent, or otherwise objectionable. HRVIEW disclaims any and all liabilities arising in relation to such offensive content on HRVIEW. The User expressly agrees and acknowledges that the Products/Services displayed on HRVIEW are not owned by HRVIEW, and that they are the exclusive property of certain third parties who have chosen to market their Products through HRVIEW. HRVIEW is in no way responsible for the content of the same. The User may, however, report any such offensive or objectionable content, which HRVIEW may then remove from HRVIEW, at its sole discretion.

d) In places where HRVIEW permits the User to post or upload data/information, the User undertakes to ensure that such material is not offensive or objectionable and is in accordance with applicable laws. The User expressly agrees that any such material that is deemed to be objectionable/offensive may be removed from HRVIEW immediately and without notice, and further, the User’s access to HRVIEW may also be permanently revoked, at the sole discretion of HRVIEW.

e) Further undertakes not to:

  • Abuse, harass, threaten, defame, disillusion, erode, abrogate, demean, or otherwise violate the legal rights of any other person or entity.
  • Engage in any activity that interferes with or disrupts access to HRVIEW or the Services provided therein (or the servers and networks that are connected to HRVIEW).
  • Impersonate any person or entity, or falsely state or otherwise misrepresent his/her affiliation with a person or entity.
  • Publish, post, disseminate, any information that is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner under any law, rule, or regulation currently in force; or unlawfully threatening or unlawfully harassing, including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986.
  • Post any image/file/data that infringes the copyright, patent, or trademark of another person or legal entity.
  • Upload or distribute files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of HRVIEW.
  • Download any file posted/uploaded by another user of HRVIEW that the User is aware, or should reasonably be aware, cannot be legally distributed in such a manner.
  • Probe, scan or test the vulnerability of HRVIEW or any network connected to HRVIEW, nor breach the security or authentication measures on HRVIEW or any network connected to HRVIEW. The User may not reverse look-up, trace or seek to trace any information relating to any other user of, or visitor to, HRVIEW, or any other customer of HRVIEW, including any user account maintained on HRVIEW not operated/managed by the User, or exploit HRVIEW or information made available or offered by or through HRVIEW, in any manner.
  • Disrupt or interfere with the security of HRVIEW, systems resources, accounts, passwords, servers, or networks connected to or accessible through HRVIEW. You agree not to use any device, software, or routine to interfere or attempt to interfere with the proper working of HRVIEW or any activity being conducted on HRVIEW.
  • Collect or store data about other users of HRVIEW.
  • Use HRVIEW or any material or content therein for any purpose that is unlawful or prohibited by these Terms or to solicit the performance of any illegal activity or other activity that infringes the rights of HRVIEW or any other third party(ies).
  • Violate any code of conduct or guideline which may be applicable for or to any particular product or Service offered on HRVIEW

SUSPENSION OF USER ACCESS AND ACTIVITY

Notwithstanding other legal remedies that may be available to it, HRVIEW may, in its sole discretion, limit the User’s access and/or activity by immediately removing the User’s access credentials either temporarily or indefinitely, or suspend/terminate the User’s membership, and/or refuse to provide the User with access to HRVIEW, without being required to provide the User with notice or cause:

a) If the User is in breach of any of these Terms or other policies of HRVIEW;

b) If the User has provided wrong, inaccurate, incomplete, or incorrect information;

c) If the User’s actions may cause any harm, damage, or loss to other users or to HRVIEW, at the sole discretion of HRVIEW.

INDEMNITY AND LIMITATIONS

The User hereby expressly agrees to defend, indemnify and hold harmless HRVIEW, its employees, directors, officers, agents, and their successors and assigns against any and all claims, liabilities, damages, losses, costs, and expenses, including attorney's fees, caused by or arising out of claims based upon the User's actions or inactions, including but not limited to any warranties, representations, or undertakings, or in relation to the non-fulfillment of any of the User’s obligations under this Agreement, or arising out of the User's infringement of any applicable laws, rules, and regulations, including but not limited to infringement of intellectual property rights, payment of statutory dues and taxes, claims of libel, defamation, violation of rights of privacy or publicity, loss of Service by other subscribers, or the infringement of any other rights of a third party.

In no event shall HRVIEW be liable to compensate the User or any third party for any special, incidental, indirect, consequential, or punitive damages whatsoever, including those resulting from loss of use, data, or profits, whether or not foreseeable, and whether or not HRVIEW had been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence, or other tortuous action, or any other claim arising out of or in connection with the User’s use of or access to HRVIEW and/or the Products, Services, or materials contained therein.

The limitations and exclusions in this section apply to the maximum extent permitted by applicable law, and the Parties expressly agree that in the event of any statute, rule, regulation, or amendment coming into force that would result in HRVIEW incurring any form of liability whatsoever, these Terms will stand terminated one (1) day before the coming into effect of such statute, rule, regulation, or amendment. It is further agreed to by the Parties that the contents of this Section shall survive even after the termination or expiry of the Terms.

The Service may contain links to third-party websites or resources. You acknowledge and agree that HRVIEW is not responsible or liable for:

1. The availability or accuracy of such websites or resources; or

2. The content, products, or services from such websites or resources.

You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources. HRVIEW provides these links as a convenience only, and a link does not imply HRVIEW's endorsement of, sponsorship of, or affiliation with the linked site. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any of these third-party services or websites

TESTS OFFERED

HRView offers a range of comprehensive tests designed to meet various professional, corporate, and academic needs. Our tests are meticulously crafted to assess and evaluate the skills, knowledge, and capabilities of individuals in different domains. Below are the tests offered by HRView:

1. Corporate Tests:These tests are tailored to assess skills and competencies relevant to the corporate world. They cover a wide range of subjects, including leadership, management, communication, and more. Corporate tests are ideal for professionals looking to enhance their career prospects.

2. HRView Tests:Our proprietary HRView tests are specially designed to evaluate candidates' suitability for human resources roles. These tests assess HR-specific knowledge, interpersonal skills, and other essential qualities required for HR professionals.

3. College Tests:College tests provided by HRView are geared towards students and individuals seeking admission to educational institutions. These tests encompass a variety of subjects and aptitudes to aid in the admission process for colleges and universities.

Process for Refund:

1. Eligibility for Refund: HRView will issue a refund to customers in cases where they encounter technical issues that prevent them from accessing or completing a test, or if there is a significant error in the test content. Refunds are not available for other reasons.

2. Refund Request Period: Customers must submit a refund request within 2 business days from the date of the test purchase. Requests received after this period will not be considered.

3. Refund Request Process: To initiate a refund request, customers should send an email to HRView's designated support address support@hrview.com. The email should include the order number, a brief description of the issue, and any relevant supporting details.

4. Refund Method: Approved refunds will be processed by returning the original payment to the customer's credit card or the source of the initial payment. Depending on the customer's financial institution, it may take up to 5-7 business days for the refund to reflect in their account.

PROCESS FOR CHANGE OF TEST

- Contact HRVIEW at support@hrview.com with your test change request.

- Once approved, fill up the “test Change Form” and submit it within 3 business days.

- In 5-7 business days, you will get a confirmation for the test change request.

CANCELLATION

HRView reserves the right to cancel any test session or change the location of the session for reasons such as instructor unavailability, insufficient participants, or due to force majeure events such as earthquakes, fire, flood, riots, curfew, bandh, protest, strike, civil unrest, etc.

Please note that HRView's cancellation policy is governed by the following:

1. Cancellation by HRView: In the event that HRView cancels a test session, workshop, seminar, or conference, participants will receive a 100% refund of the fees paid.

2. Change of Location:If HRView decides to change the location of an event, arrangements for a similar infrastructure as originally planned will be executed.

3. Personal Expenses:HRView will not be responsible for covering personal expenses incurred due to changes in the location of an event. Participants should be prepared to handle any travel or logistics-related costs on their own.

JURISDICTION

The Parties explicitly agree that the Terms, Policy, and any other agreements entered into between the Parties are subject to and governed by the laws, rules, and regulations of Karnataka, India. Furthermore, the Parties agree that any disputes or legal matters arising between the Parties shall be exclusively under the jurisdiction of the Courts located in Bangalore, Karnataka. FORCE MAJEURE

Hiredpro Training And Placement shall not be held liable for the failure to perform, or any delay in the performance of, any of its obligations when such failure or delay is caused by events substantially beyond its control. These events include but are not limited to acts of God, acts of public enemies or governmental bodies in their sovereign or contractual capacity, war, terrorism, floods, fires, strikes, epidemics, civil unrest or riots, power outages, and unusually severe weather. This force majeure clause is in place to recognize that there are circumstances beyond the control of Hiredpro Training And Placement that may affect the performance of its obligations, and it aims to address such situations in a fair and reasonable manner.

NOTICES

Any communication regarding a dispute or grievance experienced by the User should be submitted to the Company in writing. Users can send such communications to the registered office of the Company via Registered Post Acknowledgment Due/Speed Post Acknowledgment Due (RPAD / SPAD). This clause outlines the preferred method of communication for dispute resolution and ensures that such communication is documented and tracked.

SEVERABILITY

If any provision or section of these Terms is deemed invalid, illegal, or unenforceable by a court or authority with competent jurisdiction, the validity, legality, and enforceability of the remaining provisions or sections of these Terms will not be affected. The remaining provisions or sections shall remain valid and enforceable to the fullest extent permitted by law. In such cases, these Terms will be adjusted to the minimum extent necessary to correct any invalidity, illegality, or unenforceability while preserving the original rights, intentions, and commercial expectations expressed in this agreement.

ENTIRE AGREEMENT

These terms and conditions, in conjunction with our privacy, disclaimer, and cookies policy, constitute the entire agreement between you and us regarding your use of our website. This agreement supersedes all previous agreements between you and us concerning your use of our website. MISCELLANEOUS PROVISIONS

- Transfer of Rights and Obligations: Hiredpro Training and Placement reserves the right to freely transfer or assign its rights, delegate its obligations under these Terms, or any Program-specific terms. Users are not permitted to transfer or assign their rights, delegate their obligations without prior written consent from Hiredpro Training and Placement.

- Governing Law and Jurisdiction: These Terms and any Program-specific terms are governed by the laws, rules, and regulations of Karnataka, India. Disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore. Disputes should initially be resolved through good faith negotiations, and if unsuccessful, arbitration under the Arbitration and Conciliation Act, 1956 shall apply with Mumbai as the seat for arbitration.

- Severability: If any provision of these Terms or any Program-specific terms is found to be unlawful, void, or unenforceable, the other provisions will remain in full force and effect. Hiredpro Training and Placement shall not be liable for any failure to perform its obligations due to factors beyond its reasonable control, and it shall not be responsible for damages caused by unauthorized changes to these Terms.

- Non-Waiver of Rights: The failure of Hiredpro Training and Placement to exercise or enforce any right or provision in these Terms shall not constitute a waiver of such right or provision. If any provision is found to be invalid, the court should attempt to give effect to the parties' intentions, and the other provisions shall remain in full force and effect.

- Entire Agreement: These Terms and any Program-specific terms constitute the entire agreement between you and Hiredpro Training and Placement. They may only be modified in writing, either as posted on the Platforms by Hiredpro Training and Placement or through a specific agreement between the parties.
